CLIENT SERVICE AGREEMENT
General Terms. The Client hereby acknowledges that the purchase of this coaching session, program, package, or subscription (the “Service”) indicates, based on the information in Section 2 of this Agreement, the Client’s commitment to pay for the Service in full, to participate in the Service, and to follow the Service through to its conclusion. If the Client is opting for a subscription or payment plan, the Client's submission of this form indicates his/her/their agreement to be automatically charged the price advertised for the exact number of installments advertised for the payment plan or subscription the Client purchases.
Service Details. The Service that the Client agrees to engage in pursuant to this Agreement is The North Star Body 12-week coaching program, which includes twelve (12) total coaching sessions. The Client will be charged a total amount of $2500, to be paid in 1 installment of $2500.
Appointment Scheduling. All appointments as part of the Service will be mutually scheduled at an agreed upon time by the Client and the Instructor, and a web-based calendar invitation will be sent to the Client by the Instructor, including a link to the video call through which the Service will take place. Once the appointment is scheduled and an email notification sent, the appointment is considered fixed and is subject to the refund and cancellation policy contained in Section 4 of this Agreement, regardless of if/when the Client accepts the calendar invitation.
Refunds and Cancellations.
(a)The Client acknowledges and accepts that all purchases are non-refundable. Refunds and cancellations may be considered on an individual basis, at the sole discretion of the Instructor.
(b) In addition to clause 4a, the following guidelines apply to refund or cancellation requests:
(i) Once an order is placed, there are no refunds.
(ii) Once an appointment is scheduled (see Section 3 of this Agreement), it is considered a fixed appointment. If necessary, the Client may request to reschedule a session no less than 24 hours in advance by contacting the Instructor via email at support@thenorthstarbody.com.
(iii) The Client is entitled to one (1) rescheduled appointment per coaching session, if requested more than 24 hours in advance. Subsequent requests for rescheduling, or requests made within 48 hours of the scheduled appointment time will not be honored, and the coaching session will be forfeited by the Client.
(iv) Missed sessions and sessions that are cancelled with within 24 hours of the scheduled appointment time will be forfeited by the Client.
(v) The Client is responsible for completing all required forms and waivers that may be sent after booking. Failure to complete intake forms and liability waivers prior to the first scheduled session may result in a forfeited session. The Instructor will not be held liable for loss of session time or session quality if required forms are submitted less than 48 hours before the scheduled appointment time.
(vi) If the Client requests a refund or cancellation due to extenuating circumstances, the Client must have participated fully in the Service up to the time the request is submitted. This includes having attended all coaching calls, completed all program action items and/or assignments, and corresponded a minimum of twice weekly with the Instructor via text, email, or online messaging platform in order for the request to be considered.
(vii) If the Client has chosen a monthly payment plan or subscription and chooses not to continue the program for any reason, the Client will forfeit any remaining coaching sessions and assumes full liability for the amount owed for the entire program or subscription. The Client will continue to be automatically charged for the agreed upon amount of installments of the amount indicated in Section 2 of this Agreement.
(c) The Instructor reserves the right to consider any refund or cancellation request to be unreasonable, and therefore unqualified for consideration. Unreasonable requests include, but are not limited to the following reasons:
(i) Buyer’s remorse or the Client regretting the purchase after making it.
(ii) The Client’s inability or unwillingness to make time to participate in the Service.
(iii) The Client’s decision to prioritize a different program or endeavor after purchasing the Service.
(iv) The Client’s assertion that, after purchasing, they no longer require the Service.
5. Termination. The Client acknowledges that the Instructor reserves the right to terminate the coaching relationship with the Client at any time and for any reason, effective immediately upon provision of written notice to the Client. In the event that coaching services are terminated by the Instructor, the Client will be entitled to a refund for no more than the amount equal to the portion of the Service not yet rendered at the time of termination. If the Client has purchased a program or subscription and coaching services are terminated by the Instructor, any automatic charges will cease effective the day of termination. Under no circumstances is the Client entitled to a refund for services already rendered.
6. Execution. By paying for the Service, the Client hereby agrees to the terms of this Agreement and affirms full and complete acknowledgement, understanding, and consent to all conditions outlined therein.
